Terms and Conditions of Service for Kickingwoman Designs

Welcome to Kickingwoman Designs (the “Site”). These Terms and Conditions govern your use of and purchases made from the Site. By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By placing an order or browsing the Site, you confirm that you are at least 18 years of age (or have reached the age of majority in your jurisdiction) or are visiting the Site under the supervision of a parent or guardian.

2. Products and Service Details

A. Product Uniqueness (Especially for Live Plants)

We specialize in unique designs and, specifically, live plant cuttings (such as the Monstera Albo and Syngonium Pink Splash). You acknowledge that:

Variegation: Variegation on live plants is a genetic characteristic, but its intensity and distribution can vary naturally and are influenced by environmental factors (light, humidity). We cannot guarantee the variegation of future growth.

Appearance: Due to the unique nature of our products, the item you receive may have slight variations in color, size, or pattern compared to the listing photographs.

B. Product Condition

We guarantee that live plants and cuttings are healthy, pest-free, and correctly identified upon shipment. We are not responsible for damage resulting from improper care or environmental conditions after the package is delivered.

3. Pricing and Payment

A. Pricing

All prices listed on the Site are in [INSERT CURRENCY, e.g., USD] and are subject to change without notice. Applicable taxes and shipping charges will be added at checkout.

B. Payment

We accept payment via Debit and Credit cards, CashApp and PayPal. By submitting an order, you represent and warrant that the payment information provided is valid and accurate.

4. Shipping and Risk of Loss (Crucial for Live Goods)

A. Shipping Methods

We ship to the addresses provided by the customer. Shipping times are estimates and are not guaranteed.

B. Risk of Loss

The risk of loss and title for all items pass to you upon our delivery to the carrier (e.g., USPS, FedEx). We are not responsible for delays, damage, or loss that occurs once the package is in the carrier's possession. We highly recommend purchasing any offered shipping insurance or expedited services for live plants, especially during extreme weather.

C. Kickingwoman Designs will not be held accountable for any shipping delays AFTER the product has been handed over to the USPS, UPS, FEDEX etc. I can not control what happens during the shipping process. If your plant or product arrives DOA or unhealthy, I will work with you! If your plant or product arrived damaged or dead please do the following immediately after opening your package: 1. Take several pics of the product. 2. Email me: [email protected]

3. Give me a brief description of the damage..it may be evident in the pics and sometimes it isn't. I generally check my email several times a day. 4. If you feel comfortable with sending me your phone number it will help expedite your request. Please allow up to 48 hours to process your request.

5. Returns, Refunds, and Exchanges

Our policies regarding returns, refunds, and exchanges are governed by our Refunds and Exchange Policy, available on the Site. By placing an order, you agree to the terms outlined in that policy.

6. Intellectual Property

All content on the Site, including text, graphics, logos, product descriptions, and designs ("Kickingwoman Designs Content"), is the property of Kickingwoman Designs and is protected by intellectual property laws. You may not use, reproduce, or redistribute any Kickingwoman Designs Content without our express written permission.

7. Limitation of Liability

KICKINGWOMAN DESIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE OR THE PERFORMANCE OF THE PRODUCTS.

These Terms and your use of the Site are governed by the laws of Texas and the United States of America.

We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website.
